1. Terms and Conditions

  1. The following terms and conditions (the "Agreement") form a binding contract between you and Practice Ignition Pty Limited (“Practice Ignition”), its subsidiaries and related bodies corporate. Please review the following terms carefully. By using Practice Ignition, you are agreeing to the terms and conditions that appear below and the terms and conditions located at http://www.practiceignition.com/terms.
  2. We reserve the right to amend these terms and conditions at any time and it is your responsibility to review these terms and conditions on each occasion you use Practice Ignition. You may terminate this Agreement by written notice to us (by sending an email to [email protected]) if you do not wish to be bound by such new terms and conditions. However, continued use of Practice Ignition will be deemed to constitute acceptance of the new terms and conditions.
  3. In this Agreement, “Supplier” means a third party seller of goods and services. "Services" means goods and/or services offered by a particular Supplier as described to you by that Supplier.

2. Supplier’s Responsibility

  1. You agree that the Supplier alone is responsible for complying with all applicable laws relating to that supply of the Services to you.
  2. Each Supplier will have their own applicable terms and conditions in relation to their own supply of their goods and services, and you agree to (and must) abide by those terms and conditions.
  3. You agree and acknowledge that the Supplier is the supplier of the Services and the Supplier alone is fully responsible for any and all loss, injuries, illnesses, damages, claims, liabilities and costs suffered by you, caused in whole or in part by the Supplier or its products and services.

3. Collection of Funds

  1. You authorise Practice Ignition to make periodic debits and process payments on behalf of the Supplier and acknowledge that Practice Ignition is acting as an agent for the Supplier.
  2. You agree and acknowledge that Practice Ignition does not provide any services other than the collection services pursuant to your dealings with the Supplier and has no express or implied liability in regards to the goods or services provided by the Supplier.
  3. You acknowledge that the amount agreed between you and the Supplier will be debited or processed by Practice Ignition from your account according to the terms and conditions of your agreement with the Supplier.

4. Payments

  1. “Practice Ignition” may appear as the merchant for payments debited or processed from your account and you agree that Practice Ignition will not be held liable for any disputed transactions resulting in the non supply of goods or Services by the Supplier.
  2. You authorise Practice Ignition to vary the amount of the payments from time to time as may be agreed by you and the Supplier and to vary the amount of the payments upon receiving instructions from the Supplier of the agreed variations. You agree that you do not require Practice Ignition to notify you on such variation to the debit amount.
  3. You must contact the Supplier directly if you wish to alter, stop or cancel any debit or payment arrangement.

5. Your Obligations

  1. It is your responsibility to ensure that there are sufficient cleared funds in your nominated account to enable the debit to be honoured by the debit date. If there are insufficient funds available, you agree that Practice Ignition will not be held responsible for any fees and charges that may be charged (including charge-backs) by its financial institution.
  2. You acknowledge that if a debit or payment is returned to Practice Ignition as unpaid, a failed payment fee may be payable to Practice Ignition and you will be responsible for any fees or charges applied for each unsuccessful debit attempt together with any collection fees and solicitor fees as may be incurred by Practice Ignition.
  3. You authorise Practice Ignition to attempt to re-process any unsuccessful payments as advised by the Supplier.

6. Disputes

  1. You agree that all disputes will be directed to the Supplier as Practice Ignition is acting only as the agent of the Supplier.
  2. In the event of any disputed payments, you must direct such dispute to the Supplier and your financial institution.
  3. You agree and acknowledge that in the event a claim is made, Practice Ignition will not be liable for the refund of any funds or payments and agree to reimburse Practice Ignition for any losses incurred as a result of any claim made against Practice Ignition.
